I think Dan's main point comes down to the fact that despite having additional commentary, because the content is effectively being redistributed, in full, at a time where the content is meant to otherwise be restricted in when audiences can view it, it serves as a replacement for the original which can then have a substantial negative impact on the potential of the market. ie: people now no longer need to go to the restricted distribution sources to see the content. If this redistribution with commentary occurs AFTER restricted distribution, like when the work is no longer in theatres, then it has far less potential impact on the market since lost revenue can reasonably be expected to be much less. This principle can then be extended to works where the copyright expires. Despite a movie from 1968 being distributed in full for free in 2026, the reasonable impact on the market is next to nothing, since there are no limited distribution measures in place where people should otherwise be paying the creator money. TLDR: WHEN the content is being distributed matters substantially if it's the full work, regardless of how transformative the redistribution is perceived to be.

I am very suprised that Denims won on judgment of the pleadings. I wouldn't be suprised if she won at trial. Of course, Ethan should appeal on the merits of the case. But, he should also appeal on the basis that judgment on the pleadings was inappropriate because there were issues of fact that needed to be resolved. Even though the video and reaction content were fully incorporated in the pleadings, I sincerely doubt that all issues of fact were fully incorporated. He should also appeal on the merits of the case.
