• All videos are displayed through official YouTube embeds; we do not host or store video content.
• Transcripts are sourced via third-party providers and may be incomplete or inaccurate.

4. Accounts and Security

Certain features require an account. You agree to:

Keep your login credentials confidential.
Notify us immediately of unauthorized access or use.

You are responsible for all activity under your account.

5. Free and Paid Plans

Helpolos offers both free and paid subscription plans.

Details of each plan — including current prices, credit limits, and available features — are displayed on our Pricing Page and during checkout.
Subscriptions are billed in advance for each billing period. Credits are deducted whenever you use any of the provided features.

Refunds and Withdrawal:
Because access to digital features begins immediately after purchase, you acknowledge and agree that you lose any statutory right of withdrawal once access is granted. Refunds are therefore not provided, except where required by applicable law.

We may change plan features or pricing for future billing periods at our discretion.

6. Acceptable Use

You agree not to:

Use the Service for unlawful, infringing, or abusive purposes.
Copy, scrape, or extract video data, transcripts, or AI outputs.
Circumvent credit limits or security measures.
Use the Service to infringe copyrights, trademarks, or other rights.

We reserve the right to suspend or terminate your account for violations.

7. AI-Generated Content

The summaries, mind maps, quizzes, and chat responses are automatically generated by AI.
Outputs may contain factual inaccuracies or incomplete information.

AI content is provided for informational and entertainment purposes only and should not be treated as factual, professional, or authoritative.

You are solely responsible for how you interpret or use AI-generated outputs.

8. Third-Party Content and APIs

The Service relies on external APIs and data sources, including YouTube and transcript providers.

We do not control or guarantee the accuracy, legality, or availability of third-party content.
You are responsible for complying with YouTube’s Terms of Service and applicable copyright laws.
Features may change or become unavailable depending on third-party services.

9. User Content and License

When you input prompts, questions, or other data, you retain ownership of that content. You grant us a limited, non-exclusive license to process it solely to operate and improve the Service.

We do not claim ownership of your data or reuse it outside this purpose.

10. Intellectual Property

All intellectual property rights in the Service (software, design, text, graphics, etc.) belong to Foundea GmbH or its licensors.

You may not reproduce, modify, distribute, or reverse-engineer any part of the Service without prior written permission.

11. Termination

We may suspend or terminate your account if you breach these Terms. Upon termination, your right to access the Service ceases immediately.

12. Disclaimer and Limitation of Liability

The Service is provided “as is” and “as available,” without any warranties of any kind. We do not guarantee the accuracy, completeness, or reliability of transcripts, AI‑generated outputs, or embedded video content.

To the fullest extent permitted by law:

Foundea GmbH’s total liability for any and all claims (whether in contract, tort including negligence, or otherwise) arising out of or relating to the Service or these Terms shall not exceed the greater of: (a) the aggregate amount of fees paid by you for the Service in the twelve (12) months immediately prior to the event giving rise to liability; or (b) EUR 100 (or another nominal amount).
In no event will Foundea GmbH be liable for indirect, incidental, special, consequential or punitive damages, including without limitation loss of profits, loss of business, loss of data, or loss of use, even if advised of the possibility of such damages.
The above limitations do not apply to liability for (i) death or personal injury caused by our negligence; (ii) fraud or willful misconduct; (iii) breach of essential contractual obligations (cardinal duties) caused by our gross negligence; (iv) liability the statutory law does not permit us to exclude.

13. Indemnification

You agree to indemnify and hold harmless Foundea GmbH, its employees, and affiliates from any claims, damages, or losses arising from your use of the Service, your content, or your violation of these Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Germany.
Any disputes shall be resolved exclusively in the competent courts of Ulm, Germany.
