9th Circuit Panel Signals Deference in Oregon National Guard Federalization Case

Dive into the Ninth Circuit oral arguments that suggest a high degree of deference granted to the President's declaration of domestic rebellion, potentially validating the federal takeover of state troops.

Short Summary

  • The 9th Circuit panel showed significant skepticism toward Oregon's challenge, implying a favorable ruling for the federal government's justification to federalize the National Guard.
  • The key legal question is whether a President can exert emergency power based on stale facts or must demonstrate continuing, present danger at the time of deployment.
  • Michael Popok predicts that appellate courts are highly inclined to accept the executive branch's factual recitation of "rebellion," challenging traditional limitations on federal intervention.

This analysis breaks down the oral arguments regarding the legality of Donald Trump's authorization to command the Oregon National Guard under 10 U.S.C. § 2406. Readers will gain insight into the judicial tilt concerning executive power deference and the narrow scope available for states to successfully argue against federal mobilization during unrest.

Popok provides an overview of what went down today at the 9th Circuit as a 2-Trump judge panel considered whether Trump will be able to mobilize federal troups and the Oregon national guard because of bad things that happened in Portland 4 months ago, or 5 years ago. The Trump justices in that hearing sounded like they wanted to use any violence or misconduct from any point in time in any geographical location as a reasonable reason to deploy the national guard in Portland. They also completely ignored that Portland Police didn’t need assistance

These guys are bought. THere is no reason in any circumstance to send the military for short term protests involving 30 to even 500 people. Your country is loss with judges thinking the way these idiots do. An absolute farce.
