Hamilton vs. Jefferson: The Clash Shaping American Power and Constitutional Interpretation

Discover how the foundational conflict between Alexander Hamilton and Thomas Jefferson directly informs modern Supreme Court debates over executive power, administrative agencies, and constitutional meaning. Readers gain clarity on why today's polarized legal landscape is rooted in revolutionary-era ideological warfare.

Short Summary

  • FDR strategically rebranded the Democratic Party, elevating Thomas Jefferson to patron saint of the New Deal to justify expansive federal action.
  • Contemporary originalism is internally divided; scholars note a basic debate exists between justices supporting liberal versus strict construction.
  • Key constitutional challenges, like overturning the Humphrey’s Executor ruling, ignore historical complexities by seeking a single original understanding.
  • Hamilton explicitly supported holding presidents accountable through impeachment and criminal prosecution for misconduct.

Jeffrey Rosen details how presidents, notably Franklin Delano Roosevelt (FDR), actively co-opted Jefferson’s image to justify expansive federal action, often ignoring his true philosophical alignment. The conversation moves to contemporary judicial philosophy, highlighting that "originalism" conceals a core disagreement over whether to construe the Constitution liberally or strictly. This fundamental conflict drives ongoing challenges against the administrative state and recent doctrines like presidential immunity.

It's just too bad that Donald Trump can't retain anything he reads. His legacy of mental illness is profound and so dangerous.

Agreed. There is absolutely no basis in the Constitution for 'absolute immunity of the President.' This was pulled out of the ether, or maybe someone's posterior, which gives the lie to the whole 'Originalism' bullsh**.
