$5 MILLION Bribe to Trump EXPOSED?!?!

Attorneys Brian Kabateck and Shant Karnikian follow the money on the FDA's first-ever authorization of fruit-flavored vapes. On April 30, Reynolds American donated $5 million to a Trump-backed super PAC. Two days later, Reynolds and Altria executives had lunch with Trump at his Jupiter, Florida golf club and complained about FDA regulation. Trump interrupted the meeting to call FDA Commissioner Marty Makary, and when Makary didn't answer, he called RFK Jr. and Dr. Oz to complain about the agency's vape restrictions. Five days after the donation, the FDA authorized mango and blueberry flavored e-cigarettes for the first time in the agency's history, reversing years of denials. Makary, who reportedly hesitated over the impact on children, resigned days later. CDC data shows the vast majority of middle and high school e-cigarette users prefer fruit and candy flavors. Reynolds also gave $10 million to Trump's 2024 super PAC and offered donations to the White House ballroom project. Brian and Shant note the contradiction with RFK Jr.'s MAHA agenda of banning food dyes while greenlighting flavored nicotine products for an industry that paid to play. The best legal hook for challenging it is the APA: under the Tobacco Control Act, new nicotine products require pre-market applications with scientific evidence showing the product protects public health.
