Per the TOS of Github you agreed to allowing forking of your repository the moment you make it public. So long the code is not used, modified or distributed against the terms in the license agreement you are free to make a fork of a public repo. In other words... This was a malicious DMCA filing. I do find it hilarious tho 😂
Filing DMCA takedowns means they're never changing their stance on open sourcing it, which is just pathetic after 2 leaks.

DMCA needs to cut both ways. Frivolous and erroneous attempts need to reimburse the owners for lost time at a competitive rate, including attorneys fees, and pain and suffering, plus a significant fine that scales with revenue.
