Normally, I agree with Jon, but i think he is underselling the danger. These are all the starting steps. If you fire someone illegally, they could stay fired for years while it gets appealed through court. You could refuse to bring them back, and that refusal will spend years in court, assuming a hyper partisan court won't uphold the illegal termination or you don't simply give up.

Jon, ever hear the joke about finding a lump of what looks like dog poo on the side walk? You pick it up, examine it closely, you smell it, even, just to be certain, you taste it.
