Trump Faces MONSTER 23 State Lawsuit After Election Move

Attorneys Brian Kabateck and Shant Karnikian break down the multi-state lawsuit challenging Trump's latest executive order attempting to federalize control over mail-in voting. California Attorney General Rob Bonta is co-leading a coalition of 23 attorneys general plus the Governor of Pennsylvania in what Bonta calls a "shocking and unprecedented power grab." The executive order directs DHS and the Social Security Administration to build a federal list of eligible voters, requires the U.S. Postal Service to cross-reference that list before delivering ballots, and threatens state election officials with criminal prosecution for mailing ballots to anyone not on the federal list. Brian and Shant walk through why this is dead on arrival — the Constitution explicitly gives states and Congress control over elections, not the president. The 10th Amendment reserves those powers to the states, and the anti-commandeering doctrine prohibits the federal government from forcing state officials to enforce federal programs. Trump tried a similar order in March 2025, and three federal courts blocked it. This is attempt number two, and as Bonta put it, Trump "seems to embrace a philosophy of if at first you don't succeed, break the law again." Meanwhile, the Heritage Foundation's own research shows voter fraud occurs at a rate of roughly 0.00001% — making the entire premise a solution in search of a problem that doesn't exist.
