I’m native in OK. In 2022 I was arrested for “disorderly conduct” in my pajamas with no ID (long story short here, was never charged with anything and case got dismissed in federal court). They told me I could go to the hospital or go to jail and I didn’t have insurance anymore, so they took me to jail. When they were getting my info, they found out I am Cherokee and realized they didn’t have jurisdiction over me due to the McGirt ruling from the Supreme Court. That meant they couldn’t just let me leave, they had to hold me and take me to county jail, but they couldn’t tell me what exactly I’m being arrested for and my rights were never read to me. They did say I’d probably be released right after booking since I was held in city jail for a few days. That didn’t happen. When I was finally transferred to county I was forced to go through the humiliation ritual that robs you of a piece of your dignity that you never get back. It was during the pandemic, so we were on 23-hour lockdown. Some days we were never let out of our pods, depending on which guard was on duty. My cell mate was a convicted arsonist and attempted murderer. He said the arson charge was bogus because he set his own car on fire, but his girlfriend WAS inside. I was told I would be held until a judge could review my case sometime in the following month. When I was released, I was denied a public defender, even though I was not working at the time (had just left a 15 year career as a news producer and was recovering from a medical procedure) and was not released on bail. If you don’t know, it’s almost impossible to get a public defender if you or someone you know has the funds to bail you out. They wouldn’t tell me why I was denied a public defender. My court case was a story in itself. I basically defended myself in federal court and got everything dismissed. I have not been able to find an attorney who will talk to me about my civil rights being violated. They all hang up when I say McGirt. I can’t get the tribe to look at it because they don’t want to take on the govt and I got the case tossed, so what do I have to really complain about? Sorry to type a novel. I didn’t intend on putting this out there, but it kinda feels good to get it out. PS, I do have the bodycam video of my arrest. It shows me doing nothing unlawful. Thanks for reading this far. 💙
