The fundamental flaw with the Court's rationale is saying that partisan gerrymandering is a legitimate government interest. They specifically said the members of the government have a legitimate interest in protecting their incumbency. That is so fucking backwards, it's hard to even know where to begin. Fundamentally, the way a representative democracy works is that voters need to be free to choose their representatives, AND be free to vote them out if they are underperforming. It can never be a legitimate government interest for an elected representative to win, then turn around and remove the ability of the people that voted them in to vote them out. This started with Rucho v. Common Cause, and every decision the Court has made since then flows from it. That's not even counting the terrible decision in Shelby County v. Holder. And the thing is, you know if the Court wanted a different outcome, they'd find some way to have it. It's so disheartening as a lawyer to pretend every day that precedent means anything at all, as opposed to being a facade for judicial preferences.
