Thank you to our Sponsor Manscaped! Use code LawNerd to get 20% off and Free Shipping. Https://www.manscaped.com We are now over a week out of the Oscars and the fallout from Will Smith slapping Chris Rock on stage isn’t over. From what happened to what the potential legal consequences are it’s time to break it down. Plus, if you were wondering about the difference between Assault and Battery, legally, I’ve got you. If you’ve been following my coverage of the Ghislaine Maxwell trial you know that I was concerned about the motion for New Trial based on Juror 50’s failure to disclose his past experiences when directly asked on the questionnaire. However, the Judge found that Juror 50 testified credibly, that the failure to disclose was a mistake and not deliberate and that he was not biased against Maxwell and therefore would not have been struck for cause. For those reasons the Court denied the motion and reaffirmed that the sentencing will move forward. My thoughts: 1. I do believe Will should have been escorted out... not just asked (thru his publicist?) to leave. 2. I think Chris Rock was taking the long view when he decided not to press charges. While he had every right to press charges against Will, doing that would change the dynamic of the situation, making it all about the tension between the two of them. As it stands, it looks like Chris is taking the high road and will was being a jackass. 3. In the PR campaign to recover the tatters of his career, going to an after-party and celebrating... was not a good idea. A truly contrite man would have simply gone home (or back to the hotel) for the night. 4. Will earned the Oscar before the slap. He should keep it. Especially as his current projects are drying up. It will be a reminder of what will no longer be achievable for him. And finally... I do believe that all Award Shows should adopt and publish the policy that ANYONE who comes on stage uninvited will be automatically escorted out. I'm thinking of both Will Smith and Kanye West.

Emily I almost forgot. I wore my facts not fictitious shirt to my surgical consult and not only did the doctor but also his resident absolutely love the shirt and needed to get their hands on one for themselves. Because I messed up my own order and you were so gracious I actually gifted him the shirt that was too big for me. He's convinced that everyone else in the hospital is probably going to love it and need to order one too so I pointed it in your direction. I think I might see a whole bunch of med students and residents were in the shirt in the hospital next time I go. I think it should be mandatory for doctors and patients. Thank you so much Emily you made my day weekend month they asked me where they could get one and I told them they think it's the best thing since sliced bread

There should have been security to keep anyone from getting to that stage. The Academy failed in lots of ways. I am not sure if banning him from attending for 10 years feels like much of anything.

All things considered, Chris’s joke was pretty mild. I mean he could have mentioned GI Jane’s entanglements.

It's pathetic. As somebody who has struggled with hair loss from childhood up to now and who has shaved her head multiple times, I'm appalled by his behavior and Jada's immaturity. It's ridiculous.

The most interesting and frankly initially a bit shocking aspect, was the very very different perspectives of various people. Many brought up points I had not considered. A learning opportunity from a painful situation. What became more upsetting was that it now appears many people in positions of authority straight up lied or manipulated the situation to cover their butts and minimize the outcome. Very disappointed.

The Ghislane Maxwell trial juror actually found out during an interview that there was a question about being a victim of sexual assault. You could tell he was shocked and taken aback. He even commented on how his face and ears were getting red because of the shock/embarrassment. If the judge had seen that interview, they would know he was telling the truth and did not purposefully withhold the truth.

I think when the lawyers are asking questions to the possible jurors about a case such as SA. No matter what the person put down on the questionnaire should be asked.
