Balenciaga wasn’t accidentally caught up in this. THEY ARE COMPLICIT.
I worked in the fashion industry. I worked in sales. The amount of checks and balances put into place for photo shoots is phenomenal and actually a waste of money - that gets passed on to the consumer! Between brand representatives, PR, marketing, sales, and all of their assistants, make up artist, stylist, runners, talent, agent, parents of minors, etc.. There is no way they can cry foul! This brand is a disgrace! The parents of these children are a disgrace! Edit: Many are blaming the photographer, but these campaigns typically start with the PR department and the stylist. They come up with the concept and present it to the brand execs. The brand gets legal approval (especially when they’re this large) and then the rest of the players get involved. If you look at the stylist’s (now private) Instagram, you’ll see an entire account of freakish posts filled with S&M, blood and bondage. Balenciaga knew exactly who they hired when they hired this well known Russian stylist, Ladavia “Lotta” Volkova!
The lack of parental protection of the children is appalling.
I can't believe any lawyer would even consider that Balenciaga actually has a leg to stand on here. There is no "unapproved" when it comes to marketing.
In corporate speak, they’re saying they are 1) understaffed 2) disorganized and 3) have mismanagement at the top.
Balenciaga has board room meetings on where to place a dress’s zipper, let alone an entire marketing campaign. Come on !! Shame on them!
As a marketing designer, the process to get final pieces approved, greenlit by legal and management because our top 2 priorites are to profit while CYA, is always longer than the actual design time. EVERYTHING from requests, disclaimers, revisions, to final approval is ALL in writing. They are culpable. They approved it. End of story.
So Balenciaga are gonna sue the company they paid to make the ad even though that ad would never been aired without Balenciaga's sign off? Sounds like scape goating to me.
