MA v. Brian Walshe Trial Day 5 - Cellphone Testimony, Crime Scene Evidence & The ME.
Day 5: Defending Pre-January 1st Normality Amidst Digital Forensics and Grim Evidence Unveiling
Explore how the defense built a timeline of normalcy using text messages and search history leading up to January 1st, contrasting it sharply with the chilling physical evidence recovered from dumpsters later presented in court.
Short Summary
- Defense attorney Tipton methodically cross-examined Trooper Keefe, highlighting the Commonwealth’s decision not to merge data from all recovered devices for full context.
- Digital evidence revealed Brian Walsh searching for William Fastau on Christmas and sending unusual text messages on January 2nd suggesting knowledge that Anna's phone was unresponsive.
- Retired Trooper Sullivan introduced gruesome physical evidence, showing the meticulous collection of tools (hacksaw, hammer, shears) and stained carpet found in a Peabody trash site.
- The jury learned that Trooper Michael Proctor, linked to previous controversial cases, was the assigned MSP Case Officer for this investigation.
This session centered on establishing context—both digital and procedural—before the evidence became overtly severe. The defense strategy aggressively focused on behavior occurring between December 25th and December 31st to frame the defendant’s actions as non-premeditated. The introduction of crime scene personnel and the Medical Examiner set the stage for scientific testimony regarding the recovered physical debris.

So we are to believe he's not capable of murder just dismemberment
They did none of this for a fellow fallen officer. So sad.
For the sake of argument, let's say he DID panic with her death and spiraled in a "I need to get her out of here way", that doesn't match with the cold calculated "how to make her as unidentifiable as possible" - that doesn't match the "panicked" state they're trying to push, in my opinion.
Spending my 70th bday with Emily and the Law Nerds watching an interesting trial and drinking my birthday Starbucks. Life is good.
I keep thinking "Why was the equivilant not done at 34 Fairview?" My mind responds with because Proctor had decided who to blame no actual investigation was done.
Replay crew! Highlight so far is EDB yelling FUCK about Proctor
When he’s found guilty BW will NOT be able to say ineffective council. His attorney is doing a hell of a good job with very little to work with.
The contrast between the Walsh investigation and the OKeefe investigation makes it glaringly obvious that they know how to do better, they just chose not to.
There is no :"Honey Im so worried" 30+ missed calls "Please answer" or any of such pleads with love and worry in his texs after Jan 1. So passive and cold!
If i were a juror, this cross, I'd be fighting to stay awake.
