Description

In this episode of Legal AF, host Ray Brescia speaks with legal scholar Paul A. Gowder, the Frederic P. Vose Professor of Law at Northwestern Pritzker School of Law, about the Supreme Court’s recent decision in Trump v. Barbara, where the Court narrowly ruled that the plain language of the 14th Amendment that establishes birthright citizenship means what it says. Professor Gowder teaches constitutional law and is the author of The Rule of Law in the Real World and The Rule of Law in the United States: An Unfinished Project of Black Liberation. Brescia and Gowder discuss the Court’s 5-4 majority opinion and the reasoning behind it as well as the dissenting and concurring opinions in the case. They also explore whether the shockingly narrow, 5-4 outcome of this ruling, when coupled with the Court’s recent lurch in the direction of an expansive view of executive authority in case after case, means that the nation is in desperate need of reform of the Supreme Court in order to restore the robust checks and balances between the three branches of the federal government that the Framers intended to create when drafting the U.S. Constitution. Supreme Court decisions should be based on justice not party lines.

Americans believed in them and they failed us and continue to do so. Supreme Court will be remembered for corruption and killing democracy.

Absolutely insane that the highest offices in our country are held to lesser standards than the rest of us. Reform or resign.

14th amendment section 3 disqualifies Trump. He should never have been allowed a second term. He’s a traitor!

It's an absolute requirement that the Supreme Court needs to be reevaluated. Even for those of us, ordinary people, the majority of the current makeup of the court is contradictory and illogical.

Yes, the supreme court requires a reform. The court is ineffective and isn’t doing enough to protect the citizens. They are only involved in protecting the politicians and not protecting the citizens.

We need to stop yapping about specific issues and just collectively go with the U.S. Constitution and how those justices are trying to change how it's interpreted. Issues allow the treasonous folks to weasle in to make us distract and argue with each other. We're all different with different priorities..only thing we need to agree on is upholding the Constitution. None of us are gonna get EVERYTHING we want. Let's agree to be united!

If one is immune from prosecution, one is not subject to the jurisdiction of the nation, if one is not subject to the jurisdiction one can not be a citizen, if one is not a citizen one can not be President, if one is not a citizen and one commits fraud or violent crime one MUST be deported under the law. No need to impeach.
