Supreme Court Makes MAJOR RULING on Immigration Case

Attorneys Brian Kabateck and Shant Karnikian cover the Supreme Court's 6-3 ruling in Mullin v. Doe allowing the Trump administration to terminate Temporary Protected Status for roughly 350,000 Haitians and 6,000 Syrians. Justice Alito wrote that Congress gave the DHS Secretary broad discretion to designate and terminate TPS, and courts cannot second-guess that decision. The court also rejected the equal protection claim that the terminations were racially motivated. In a companion case, Mullin v. Al Otro Lado, the court ruled 6-3 that asylum seekers standing in Mexico have not "arrived in the United States" and are not entitled to apply. Brian and Shant don't celebrate the ruling but urge a pragmatic reading. The goose and gander rule applies: every tool Trump just got, a future Democratic administration inherits. Want to extend TPS for Venezuelans, Ukrainians, or Gazans? Courts can't block it. Want to redesignate a country Trump terminated? Same insulation. Want to reopen the border to asylum seekers? The executive sets the policy now, and courts are out.
