Trump PANICS as Nation CALLS FOR 25TH AMENDMENT!!!

In this episode of Legal AF, Ray Brescia speaks with Yale Law Professor Harold Hongju Koh, one of the country’s leading experts in public and private international law, national security law, and human rights, and one of his students at Yale, Grady Yuthok Short. Koh directs, and Short is a student in, the Peter Gruber Rule of Law Clinic at Yale Law School, a practicum deeply committed to upholding human rights and the rule of law. Koh and Short discuss a recent updated report by the Rule of Law Clinic that provides an exhaustive analysis of the 25th Amendment to the Constitution, specifically section 4 of the amendment. Ratified in 1967 in the aftermath of the assassination of President John F. Kennedy, the 25th Amendment provides for removal of the president of the United States when he or she is “unable” to perform their duties. This report clearly explains the complex constitutional procedures for addressing presidential inability to laypeople and lawyers alike. The authors of the report emphasize that the amendment requires a flexible "totality of the circumstances" test to determine if a sitting president is genuinely unable to discharge the powers and duties of the office. Koh and Short explain some of their findings and why it is so important for the public and elected officials to understand how the removal process works.
