Lawyer here, he could just be a hired gun. I wouldn’t be surprised if her attorneys drafted the affidavit themselves, at least in part. While I am sure it happens in other cases (I have never seen it), it’s odd that he is concluding additional discovery would be necessary. That should be what the lawyers argue based on what he said, but he’s concluding that himself.
