5th Circuit Strikes Down Trump's Use of Alien Enemies Act Against Venezuela Claims

Understand the critical 2-1 ruling by the 5th Circuit that blocked the Trump administration's invocation of the Alien Enemies Act, and how this case is now on a fast track toward the Supreme Court.

Short Summary

  • The 5th Circuit ruled 2-1 that the Alien Enemies Act was improperly invoked because the U.S. is not formally at war with Venezuela.
  • The ruling issued split opinions on due process notice periods, creating a complex precedent for removal procedures.
  • This decision represents the most significant legal check on the administration’s broad immigration removal powers under that specific Act.

This analysis breaks down the components of the complex 5th Circuit decision, contrasting the majority opinion regarding statutory authority with the dissenting opinion praising executive deference. These outcomes are crucial because this case is currently the primary vehicle heading to the U.S. Supreme Court to decide the legality of mass deportations under the 1798 statute.

Description

In a stunning reversal of fortune, the 5th Circuit Court of Appeals, by a bipartisan 2-1 vote, just declared that Trump’s declaration of war against Venezuela to justify his removal of people without due process under the Alien Enemies Act was illegal, with a Trump judge “trying out” for the Supreme Court (Judge Oldham) in dissent. Michael Popok examines the case sent to the 5th by the Supreme Court in May, and the ruling within a ruling about due process. Tushy: Over 2 million butts love TUSHY. The office of the president does NOT have the authority to declare war on another nation.

Blowing up that boat is an outright act of terrorism. And where's the alleged drugs? Agents display drug hauls for publicity, but in this case nothing.

So he had murdered eleven people. Not arrested just blown away. We'll never know if they were innocent.

Not just Trump, all of the Republicans are complicit. They should all be held accountable.

Attacking a boat in international waters and killing the eleven people on board sounds like pre-meditated murder to me. You can imagine the rhetoric if anyone did that to an American boat. "An outrageous, unprovoked, murderous attack on innocents at sea". The US should be held accountable for this murderous attack in international waters.
