Twelve House Democrats sued after being repeatedly denied access to ICE facilities where they're constitutionally entitled to conduct oversight. The case centers on Section 527 of the Continuing Appropriations Act, which states "Nothing in this section may be construed to require a member of Congress to provide prior notice of the intent to enter a facility for the purpose of conducting oversight." ICE argued the seven-day notice requirement was needed for "security, logistics, and operational efficiency," and claimed field offices weren't covered since they don't technically "house" detainees. Judge Cobb rejected both arguments, finding ICE's policy "contrary to law and in excess of DHS's statutory authority." The hosts explain this is about separation of powers—Congress appropriates taxpayer money for ICE operations and therefore has the right to inspect how that money is used through unannounced visits, just like health inspectors conducting surprise restaurant checks.
