Here's the dumbest thing. The husband is not suing Disney. The husband is the executor of the estate. The estate, which is represented by the husband, is suing Disney for wrongful death. The estate never signed up for Disney+. What the husband did and didn't agree to has no bearing on the case.

I did a paper about this a few years ago, how the terms and conditions are unethical. They basically present you with a false premise that you have a choice, but you either agree to their terms or you are not allowed access to whatever it is you're trying to use.
