Brian Kabateck and Shant Karnikian discuss how in March 2026, U.S. District Judge Brian Murphy in Boston halted it all. Murphy found that Kennedy's ACIP overhaul violated the Federal Advisory Committee Act, which requires members to have expertise in immunization practices, vaccine safety, and vaccine research. He found that of 15 current ACIP members, only six appeared to have any meaningful vaccine experience. He also ruled that the CDC's unilateral reduction of the childhood vaccine schedule was arbitrary and capricious under the Administrative Procedure Act — the same APA violation the administration keeps running into. Kennedy's team is now rushing to the appeals court, claiming they need the panel reinstated before flu season to issue vaccine recommendations — which, given the administration's anti-vaccine posture, prompts an obvious question about what those recommendations would actually say.
