ID v. Bryan Kohberger - Restitution Hearing From 11-5-25
Bryan Kohberger Restitution Hearing: Plea Agreement Stipulations and Prosecutorial Error
Discover why the State of Idaho’s attempt to enforce extra restitution failed, and how the judge held the defendant to the original contract terms despite prosecutorial mistakes.
Short Summary
- The State conceded major restitution requests when realizing they fell outside the defined plea agreement boundaries.
- The defense argued that the prosecution's request violated contract law principles, though they also fought on the "ability to pay" for the undisputed funeral expenses (earns).
- Judge H admonished both sides for arguing terms already agreed upon or needlessly complicating the narrow dispute remaining.
- The discussion revealed that over \$10,000 had been placed on Kohberger's books prior to sentencing, and 20% of future inmate deposits must be diverted to pay restitution.
This commentary reviews the filings leading up to and during the recent restitution hearing in the Bryan Kohberger case. The central issue became navigating the scope of the original plea deal, especially after the prosecution admitted they misunderstood Crime Victim Compensation Fund limitations regarding family travel costs. Reviewing the arguments clarifies how plea bargains are interpreted as contracts and the judge's approach to procedural missteps.

SO glad you covered the hearing. I saw Lawyer You Know's coverage on it and thought "Emily's gonna lose it when she sees this!" Definitely a valid CODE RED
Quick update: the TikTok psychic now runs a travel vlog on YouTube. Her last post was reportedly from Bangkok on Nov. 7, 2025. It seems maybe she has been too busy with her travel vlogs to make filings for the court. Based on YouTube activity, Emily’s probably right—she won’t file anything else or appear in court, and the professor likely won’t get anything from her. Just bad decisions on top of bad decisions.
1:11 Right now I'm driving 10 hrs home because it's faster than the flight that got delayed. Who knows if it will even take off. I was supposed to be home from Mexico yesterday. I'm well over 34 hrs into trying to get home. Not an adventure I asked for. I'm missing my elderly pet, work, deadlines, spending money I don't want to on things I don't want (bad food and lodging, hydration, Uber to the lodging, rental car, gas, toll roads, fees). I still have to drive to the airport I took my 1st flight from to get my almost lost luggage, drop the rental, then find our car to drive 50 min home. Did I mention that airport is 50 min PAST home? I'm literally driving by my house to go do more sh't. You're not missing anything.
I'm Fred's lawyer and making statement on behalf of him and his family, Emily's conduct was in fact slanderous and we will be taking action abruptly lol see you in kitty litter court
EDB u mentioned the unsealing of stuff from the Read Case, Corri Hopkins who is a lawyer from North Carolina is suing for the side bars. She has been the one who has been getting a lot of the Foia requests that has been unveiling big stuff, she’s the one who unveiled Dever and Cox stuff along with a lot of other stuff. It’s so intriguing what she has gotten, she has a fight on her hands with these side bars even though there shouldn’t be a fight.

If he paid restitution at this time it would be from monies he received through donations . Maybe not? BK has money and should pay or at least set up a payment plan that works for him. Hold him responsible for what the plea deal states.
Replay crew! I have a migraine today and have so much to get done at home. Emily, you’re giving me the will to do the things right now because I can play this in the background ❤
